Rental terms

1. GENERAL TERMS

1.1. These terms govern all rentals and use of vessels provided by XPLORERS L.P., whether initiated online, in person, or by third-party agencies. 1.2. The Renter must be a natural person, at least 21 years of age, and provide a valid government-issued ID and contact details. 1.3. The Renter agrees to comply with all applicable national and local maritime laws and regulations. 1.4. The Company reserves the right to deny service to any individual deemed unfit or unsafe for operation. 1.5. Only persons listed on the rental agreement are allowed to operate the vessel. 1.6. A mandatory pre-departure safety and operational briefing must be attended. 1.7 The operator of a rented motorboat or speedboat assumes all obligations and responsibilities deriving from the applicable legislation for the management of a ship, within the meaning of article 3 of the Public Maritime Law Code, as well as the responsibility to comply with the special provisions concerning their movement, circulation and management.


2. BOOKING, PAYMENT & CONFIRMATION

2.1. Bookings must be made through our official website, phone line, authorized partners, or in person. 2.2. A 100% upfront payment is required to confirm any reservation. Provisional bookings will not be held without payment. 2.3. We accept payments via Credit/Debit Card (Visa, MasterCard), Bank Transfer (IBAN), and Cash (in person only). 2.4. All listed prices are in EUR (€) and include applicable VAT unless explicitly stated otherwise. 2.5. Additional services (e.g., skipper, fuel, catering, water sports equipment) must be selected and paid for in advance. 2.6. Any discount or promotion must be claimed at the time of booking and cannot be retroactively applied.


3. CANCELLATION & REFUND POLICY

3.1. Cancellations made more than 45 calendar days prior to the rental date are eligible for a 100% refund. 3.2. Cancellations made between 30–44 calendar days prior to the rental date will receive a 50% refund. 3.3. Cancellations made fewer than 20 calendar days before the rental date are not eligible for any refund. 3.4. No-shows or failure to appear at the designated departure time without prior notice will result in full forfeiture of the rental fee. 3.5. In case of severe weather (wind > 5 Beaufort, lightning, or coastal authority warnings), the Renter may choose to reschedule the rental or receive a full refund. 3.6. Refunds, if applicable, will be processed within 14 business days via the original payment method.


4. RENTAL CONDITIONS, OPERATIONAL RESTRICTIONS, BOARDING

4.1. The Renter agrees to operate the vessel in a safe, prudent, and lawful manner at all times. 4.2. The maximum number of passengers may not exceed the vessel’s certified limit. 4.3. It is strictly forbidden to: (a) Consume on the vessel or operate the vessel under the influence of alcohol or narcotics. (b) Navigate beyond the pre-defined safety zones. (c) Tow other vessels or objects, unless specifically authorized. (d) Operate the vessel between sunset and sunrise, unless equipped and licensed for night operation. 4.4. The vessel must not be used for: (a) Transporting goods or commercial activity without prior written agreement. (b) Hosting events, parties, or unauthorized charters. 4.5. Smoking onboard is discouraged and may be prohibited on certain vessels. 4.6. Children under 12 must wear life jackets at all times while on deck. 4.7. The Renter is liable for informing guests of all safety rules and company policies. 4.8. The Renter must arrive at least 30 minutes prior to the scheduled departure time. Delays caused by the Renter may reduce the total rental time without refund.


5. SAFETY EQUIPMENT & EMERGENCY PROCEDURES

5.1. All vessels are equipped with standard safety gear including life jackets, fire extinguisher, distress signals, first-aid kit, anchor, ropes. 5.2. The Renter can inspect and verify the presence of all safety equipment before departure. 5.3. In the event of an emergency, the Renter must: (a) Notify XPLORERS L.P. immediately via the provided contact numbers. (b) Secure passengers and drop anchor if required. (c) Avoid abandoning the vessel, unless instructed by authorities. 5.4. Failure to report accidents or damages immediately results in full liability. 5.5. The boat is equipped with GPS tracking for safety and compliance. The Renter consents to the use of such tracking systems for monitoring route, location, and speed.


6. DAMAGE, DEPOSIT & RETURN CONDITIONS

6.1. Any damage to the hull, engine, propeller, upholstery, electronics, or equipment will be repaired or replaced at the Renter's expense. 6.2 The Renter hereby agrees and accepts the following terms: (a) To return the vessel to the Lessor in the same condition as received. Any damage to the vessel or its equipment, as well as any loss or destruction caused by negligence, improper use, or violation of this Agreement, shall be the sole responsibility of the Renter and shall be assessed at the sole discretion of the Company in accordance with the current pricing list for parts, labor, and services. (b) To return the vessel to the Lessor at the agreed time and place. Early return of the vessel does not entitle the Renter to any refund, whether in full or in part, unless otherwise agreed in writing. (c) The operation of the vessel is strictly limited to the individual designated by the Renter at the time of booking, provided that said individual holds all legally required licenses or certifications. No other person, regardless of relationship or capacity, is permitted to operate the vessel during the rental period. (d) The boarding of passengers in excess of the vessel’s certified maximum capacity is strictly prohibited. Additionally, the transport of goods, animals, or any other form of cargo is not permitted without the Company’s prior written approval. (e) The navigation of the vessel in areas restricted by Greek law, international maritime regulations, or coastal authorities is strictly forbidden. Furthermore, the vessel may not exit Greek territorial waters without the prior written approval of the Company and the relevant maritime authorities. 6.3. Late return beyond the agreed time will be charged at EUR 50/hour or part thereof. 6.4. If the vessel is returned unreasonably dirty or with stains, an additional cleaning fee of EUR 100 will apply. 6.5. Any missing or broken equipment must be reported immediately and will be charged accordingly. 6.6. Disembarkation must occur at the agreed location and time, unless previously authorized.


7. FUEL POLICY

7.1. All vessels are provided with a full tank of fuel, unless otherwise agreed. 7.2. The Renter must pay for refueling at market rate. 7.3. Fuel consumption will be logged and verified upon return.


8. INSURANCE & LIABILITY

8.1. All vessels are insured for third-party liability and maritime claims. 8.2. The insurance does not cover: (a) Personal injuries. (b) Intentional or grossly negligent damages. (c) Loss of personal belongings. 8.3. The Renter is liable for all damages resulting from misuse or violation of agreement terms. 8.4. In case of theft, accident, grounding, or collision, the Renter must report the incident to the port authority and Company immediately.


9. TOWING & RESCUE COSTS

9.1. In the event that the vessel requires towing, recovery, or emergency assistance due to the Renter’s negligence, misoperation, or failure to comply with the terms of this Agreement (including, but not limited to, running out of fuel, grounding, or improper anchoring), the Renter shall bear full financial responsibility for all associated costs. 9.2. These costs may include, but are not limited to: (a) Dispatch and labor fees for recovery or towing. (b) Fuel and equipment used during the rescue operation. (c) Port authority or third-party charges. (d) Any incidental damages caused to the vessel or third parties during the incident. 9.3. The Company reserves the right to deduct such costs from the security deposit and to issue an invoice for any remaining balance, payable within five (5) business days.


10. INDEMNIFICATION & HOLD HARMLESS

10.1. The Renter shall indemnify, defend, and hold harmless XPLORERS L.P., its owners, officers, employees, and agents from and against all claims, damages, losses, and expenses arising from: (a) Personal injury or death. (b) Property damage. (c) Violation of maritime laws or these terms.


11. FORCE MAJEURE

11.1. XPLORERS L.P. shall not be liable for any delay, cancellation, or failure to perform due to force majeure, including but not limited to: (a) Weather conditions. (b)Natural disasters. (c) War or terrorism. (d) Governmental restrictions or pandemic-related orders. 11.2. In such cases, the Company will attempt to reschedule or issue partial refunds at its sole discretion.


12. PRIVACY POLICY & DATA PROTECTION

12.1. XPLORERS L.P. is committed to protect your privacy. 12.2. We collect only necessary personal data for booking, invoicing, and safety purposes. 12.3. Data is stored securely and never sold to third parties. 12.4. You may request to access or delete your data by contacting our office at [email protected].


13. PHOTOGRAPHY & MEDIA CONSENT

13.1. You may be photographed or recorded during your experience. 13.2. By accepting these terms, you grant us non-exclusive rights to use such media for marketing and social media, unless you opt-out in writing.


14. GOVERNING LAW & DISPUTE RESOLUTION

14.1. This Agreement is governed by the laws of the Hellenic Republic (Greece). 14.2. Any disputes shall be submitted to the exclusive jurisdiction of the Courts of Athens. 14.3. The parties agree to first attempt resolution through mediation or arbitration prior to litigation.


15. ENVIRONMENTAL RESPONSIBILITY

15.1. To align with maritime regulations and sustainable tourism: It is strictly prohibited to dispose of any waste, oil, plastics, or other pollutants into the sea. 15.2. The Renter is responsible for using on-board waste disposal bins and for offloading waste at designated harbor stations. 15.3. Violations of environmental laws are the sole responsibility of the Renter and may result in legal penalties.


16. HEALTH & MEDICAL CONDITIONS

This can be a liability shield in medical emergencies: 16.1. The Renter affirms that they and all passengers are physically fit for marine activity. 16.2. Any existing medical conditions (e.g. heart issues, epilepsy, motion sickness) must be disclosed in advance. 16.3. The Company is not liable for health-related incidents occurring during the rental.


17. RIGHT TO REFUSE RENTAL COMMENCEMENT

17.1. The Company reserves the unilateral right to cancel or refuse the commencement of the rental period without refund in any of the following cases: (a)The Renter appears to be under the influence of alcohol or narcotic substances. (b)The Renter fails to present the required identification, licenses, or documentation. (c) Discrepancies are found in the information provided by the Renter, or if false or misleading declarations have been made. 17.2. In such cases, the Company shall bear no obligation to refund the rental fee or provide alternative arrangements.


18. ACCEPTANCE

18.1. By signing, or submitting payment, or using our services, the Renter acknowledges having read, understood, and agreed to these Terms in full. 18.2. A copy of this agreement will be provided upon request.
